EXPERT WITNESS SERVICE

TCP has been instructed to provide expert opinion on a range of compliance issues, particularly to solicitors facing the Solicitors’ Disciplinary Tribunal or firms facing possible intervention.

Generally firms will need to have their own specialist solicitors’ firm or counsel representing them on these issues, those specialists being responsible for instructing TCP under this service.

This service includes:

  • Balanced and objective expert opinion on the interpretation of rules and regulations, informed by an understanding of how and why rules have changed over the course of time.  
  • Written expert witness evidence for submission to the SDT and, if necessary, oral evidence.
  • Use of the Compliance Audit Service to provide an independent assessment of a firm’s compliance management to assist in mitigation in the Tribunal.
  • Use of the Compliance Audit Service to delay intervention, to allow TCP to draw up an independent assessment and to assist the firm to put recommendations into place.
